Just because Kayan has a disease called cerebral palsy. It is a neurological disorder that affects children's physical movement, ability to move. Because of this, the Immigration Department also rejected his family's last application in February and gave a decree to leave the country.

Kayan's father Varun Katyal came on Australia Student Visa 12 years ago. Married in 2012 and Kayan was born in 2015. But from birth, Kayan was surrounded by cerebral palsy disease. As soon as life was back on track, Australia's Immigration Department refused to give the family a permanent resident visa in 2018. The department argued that Kayan's treatment would become a burden on Australia's taxpayers if they were granted permanent resident visas.

The medical facility in Australia free

Actually, the medical facility is free for permanent residents and citizens in Australia, the government deducts its expenses from the income from tax. Varun, who is working as a chef in Melbourne, told Bhaskar that he had asked the Immigration Department to bear the expenses of his son's illness. On this, the department asked to show a savings of about 6 crore rupees in the next 10 years for the amount spent on treatment. But we did not have such a huge amount.

They say that he has invested all his accumulated capital so far in Kayan's treatment. Not only this, 20 lakh rupees have also been invested in the visa application being rejected again and again. Meanwhile, Varun and his wife have filed an appeal in the Administrative Appeals Tribunal while Kayan's appeal is pending in the federal court. Varun, however, has started an online petition to help. Many popular and famous celebrities have come in support of Kayan.

Ellen Pearson, director of Human Rights Watch, says, "If Kayan had not been a victim of disability, it would have been an Australian citizen today." Peter MP, a Labor MP, said that reporting an Australia-born disabled child reflects the government's immorality and mismanagement.

In 2019, the Immigration Minister gave relief to the Irish family in a similar case.

According to the Migration Act of Australia, the Immigration Minister has special powers on the basis of which he can grant visa permission in such cases, but it all depends on his discretion.

A spokesman for the Home Department says that the rule is equal for everyone. These rules have been made keeping in mind the citizens of Australia, Permanent Residents, and Health Services.

In 2019, in the case of a 3-year-old Irish child, the Immigration Minister allowed the family to live using the privilege. 1 lakh people had signed a petition demanding the intervention from the government.
